Introduction
1. Who we are and how to contact us
1.1. www.mohost.co.uk/ is operated by ANNAGA Limited (“we” or “us”). We are registered in Scotland under company number SC653008 and have our registered office at 5 SOUTH CHARLOTTE STREET, Edinburgh, EH2 4AN.
1.2. Membership is open to any individual who chooses to register with the Site.
1.3. These terms will apply to anyone who views or uses the Site (“you”).
1.4. These terms relate to the services we provide (including payment) through our Site in connection with the listing and booking of pitches and electrical hook-ups listed by registered users of the Site who have registered as hosts (“Hosts”) to registered users of the Site who have registered as guests (“Guests”) (the “Services”).

2. By using the Site you accept these terms
2.1. By using the Site, you confirm that you accept these terms of use and that you agree to comply with them.
2.2. If you do not agree to these terms, you must not use the Site.
2.3. We recommend that you print a copy of these terms for future reference.
3. There are other terms that may apply to you
3.1. These terms of use refer to the following additional terms, which also apply to your use of the Site:
3.1.1. Our Privacy Policy. See further under How we may use your personal information.
3.1.2. Our Cookie Policy, which sets out information about the cookies on the Site.
3.2. If you are a Host and you wish to register your pitch with us to make it available to a Guest registered on our Site, you will be bound by our Host Terms and Conditions as these will apply to your listing(s) (and any subsequent bookings).
3.3. If you wish to book a pitch made available by a Host through our Site, you will be bound by our Guest Terms and Conditions as these will apply to any bookings made by you through the Site.
4. We may make changes to these terms
4.1. We amend these terms from time to time. Every time you wish to use the Site, please check these terms to ensure you understand the terms that apply at that time.
General
5. Your Registration on our Site
5.1. To use the Services (either as a Guest or a Host) you must create an account to become a registered user on our Site.
5.2. Registration with the Site is currently free, however in order to become a registered user you will have to provide some basic personal information. See our privacy policy at https://www.mohost.co.uk/privacy-policy/.
5.3. You agree that all information supplied on registration is true and accurate and will be kept up to date at all times. We will use the information provided to us to contact you.
5.4. You may not have more than one registration on our Site and we reserve the right at our discretion to delete or cancel the membership of any person who in our opinion possesses more than one registration at any time.
5.5. You are not entitled to allow any other person to use your registration. You may not impersonate any other person in any registration whether or not that other person is a user of the Site.
5.6. On receipt of an email by you to us cancelling your registration then we will terminate your registration as soon as practicable.
5.7. We reserve the right to terminate your registration immediately without notice if in our opinion you have breached these terms or any other applicable terms and conditions and/or policies referred to in these terms (for instance, our Host Terms and Conditions and/or our Guest Terms and Conditions).
6. How Notices are sent to you
6.1. You are responsible for making sure that all information provided to us is accurate, current and complete at all times.
6.2. All notices sent to you will be sent to the email address provided to us (as updated by you). By accepting these terms you give your consent to receive communications from us by email and you agree that all agreements, notices, disclosures and other communications that we provide to you by email satisfy any legal requirement that such communications be in writing
7. We may make changes to the Site
7.1. We may update and change the Site from time to time to reflect changes to our Services, our users’ needs and our business priorities. We will try to give you reasonable notice of any major changes.
8. We may suspend or withdraw the Site
8.1. Registration on our Site is free of charge.
8.2. We do not guarantee that the Site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the Site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
8.3. You are also responsible for ensuring that all persons who access the Site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.
9. We may transfer this agreement to someone else
9.1. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
10. The Site is directed to users in the UK
10.1. The Site is directed to people residing in the United Kingdom. We do not represent that content available on or through the Site is appropriate for use or available in other locations.
11. You must keep your account details safe
11.1. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
11.2. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.
11.3. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at support@mohost.co.uk.
12. How you may use material on the Site
12.1. We are the owner or the licensee of all intellectual property rights in the Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
12.2. You may print off one copy, and may download extracts, of any page(s) from the Site for your personal use and you may draw the attention of others to content posted on the Site.
12.3. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
12.4. Our status (and that of any identified contributors) as the authors of content on the Site must always be acknowledged (except where the content is user-generated).
12.5. If you print off, copy, download, share or repost any part of the Site in breach of these terms of use, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
13. No text or data mining, or web scraping
13.1. You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to the Site or any services provided via, or in relation to, the Site. This includes using (or permitting, authorising or attempting the use of):
13.1.1. Any “robot”, “bot”, “spider”, “scraper” or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the site or any data, content, information or services accessed via the same.
13.1.2. Any automated analytical technique aimed at analysing text and data in digital form to generate information which includes but is not limited to patterns, trends and correlations.
13.2. The provisions in this clause should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of Digital Copyright Directive ((EU) 2019/790).
13.3. This clause shall not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.
14. Do not rely on information on this site
14.1. Although we make reasonable efforts to update our information on the Site, we make no representations, warranties or guarantees, whether express or implied, that the content on the Site (whether provided by us and/or a registered user) is accurate, complete or up to date.
15. We are not responsible for websites we link to
15.1. Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.
16. User-generated content is not approved by us
16.1. Our Site may include information and materials uploaded by other users of the Site, including links to social media pages, video-sharing sites, bulletin boards and chat rooms. This information and these materials have not been verified or approved by us. The views expressed by other users on the Site do not represent our views or values.
17. How to complain about or report content
17.1. If you become aware of any material that is offensive and/or that could comprise or be connected to child sexual abuse or exploitation or that could comprise terrorist content or be connected to terrorism, please contact us immediately at support@mohost.co.uk.
17.2. If you wish to complain about any other content, please contact us at support@mohost.co.uk.
18. How we may use your personal information
18.1. We will only use your personal information as set out in our privacy policy https://www.mohost.co.uk/privacy-policy/.
19. Uploading content to the Site
19.1. Excluding personal information, any content you upload to the Site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and other users of the Site a limited licence to use, store and copy that content and to distribute and make it available to third parties. The rights you license to us are described in Rights you are giving us to use material you upload.
19.2. We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to the Site constitutes a violation of their intellectual property rights or of their right to privacy.
19.3. We reserve the right at our discretion to remove any content from the Site at any time for any reason.
19.4. If you wish to contact us in relation to content you have uploaded to the Site and that we have taken down, please contact support@mohost.co.uk.
19.5. You are solely responsible for securing and backing up your content.
19.6. You must not upload any harmful, illegal or offensive material (including any material that could incite a terrorist offence, solicit any person to participate in terrorist activities, provide instruction on any method or technique for committing a terrorist offence or threaten to commit a terrorist offence).
19.7. You must not upload any material which could damage the our reputation or that of the Site.
20. Rights you are giving us to use material you upload
20.1. When you upload or post content to the Site, you grant us the following rights to use that content:
20.1.1. a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that user-generated content in connection with the service provided by the website and across different media including to promote the site or the service to expire when the user deletes the content from the site;
20.1.2. a worldwide, non-exclusive, royalty-free, transferable licence for other users, partners or advertisers to use the content in accordance with the functionality of the site to expire when the user deletes the content from the site.
21. We are not responsible for viruses and you must not introduce them
21.1. We do not guarantee that the Site will be secure or free from bugs or viruses.
21.2. You are responsible for configuring your information technology, computer programmes and platform to access the Site. You should use your own virus protection software. You are responsible for ensuring that you use appropriate virus protection software.
21.3. You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.
22. Rules about linking to the Site
22.1. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation (or that of the Site) or take advantage of it.
22.2. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
22.3. The Site must not be framed on any other site, nor may you create a link to any part of the Site other than the home page.
22.4. We reserve the right to withdraw linking permission without notice.
22.5. If you wish to link to or make any use of content on the Site other than that set out above, please contact support@mohost.co.uk.
23. When we can suspend your use of the services and / or close your account
23.1. You acknowledge that your use of the Services is subject to our discretion and we may, in the event of your breach of these terms, at our sole discretion, suspend your account or withdraw your rights to use the Service on written notice with immediate effect.
23.2. Circumstances in which we may suspend or withdraw your account include but are not limited to, our reasonable belief that you have used an account for payment which you are not entitled to use, or you have breached these terms and conditions.
Booking
24. Your Payments
24.1. When you, as a Guest, use our Site, we are providing you with the means to enter into individual, direct contracts with the Hosts to use the pitch and electric hook-ups made available by them on our Site and we facilitate the payment for your use of the pitch and electric hook-up, provided by the Host. We do not have control over nor are we responsible for the Hosts (nor do we warrant any of the information provided on any Host’s listing), we simply facilitate the booking and payment for your use of the pitch and electric hook-up.
24.2. Payments will be taken and made using Stripe and in the amounts specified in:
24.2.1. Clauses 8 and 9 of the Host Membership Terms and Conditions; and
24.2.2. Clauses 8 and 9 of the Vehicle Membership Terms and Conditions.
25. How to make a booking
25.1. To make a booking:
25.1.1. Search for a host listing through the Home Page region selector, Places to mohost page or through the Site-search bar.
25.1.2. Select the appropriate host venue and choose available dates.
25.1.3. Once you select to reserve a pitch a modal experience will open up for you to enter your personal and payment details to book this time slot.
25.1.4. You will be required that you confirm that you accept the guest and booking terms & conditions before you are allowed to proceed.
Liability and Jurisdiction
26. Our responsibility for loss or damage suffered by you
26.1. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
26.2. Different limitations and exclusions of liability will apply to liability arising as a result of using the Services, which are set out in our Host Terms and conditions and Guest Terms and conditions.
26.3. We will not be liable to you for any loss or damage, whether in contract, tort/delict (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
26.3.1. use of, or inability to use, the Site; or
26.3.2. use of or reliance on any content displayed on the Site.
26.4. In particular, we will not be liable for:
26.4.1. loss of profits;
26.4.2. loss of sales, business, or revenue;
26.4.3. business interruption;
26.4.4. loss of business opportunity;
26.4.5. loss of agreements or contracts;
26.4.6. loss of anticipated savings;
26.4.7. loss of use or corruption of software, data or information;
26.4.8. loss of or damage to goodwill and/or reputation;
26.4.9. indirect or consequential loss;
26.4.10. property damage (including, for example, damage to a building or vehicles parked in the vicinity of the Pitch) and/or damage to a vehicle and/or a pitch;
26.4.11. loss in connection with the use of, the inability to use, the Site; and/or
26.4.12. use of, or reliance on, any content displayed on the Site and/or any information or data provided to You through the Site or directly by Us.
27. You are responsible for paying all charges and fines/penalties
27.1. You shall pay all of the charges in relation to your use of the Services and the booking and use of your chosen pitch.
27.2. You are also liable to pay any fines, penalty notices or similar you receive in connection with your making available, or using, a pitch and/or electrical hook-up. We will under no circumstances be liable to you for any loss or damage you may suffer in relation to any fines, penalties or similar applied by authorities to you in relation to your breach of any rules, regulations, road markings or other relevant legislation.
28. Which country’s laws apply to any disputes?
28.1. Each party irrevocably agrees that the Scottish courts shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these terms or its subject matter or formation.
28.2 These terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation, shall be governed by and construed in accordance with the law of Scotland.
